The Magistrates Court of SA introduced mediation as part of the process of pre trial management of cases nearly 30 years ago. Since that time, the Court has introduced a range of innovative ways to assist parties to mediation and has resulted in significant numbers of cases being diverted from Court early in proceedings. Judy and Marg will talk about some of these initiatives, explain how the process for accessing mediation operates in the Magistrates Court today, and discuss some of the findings of their joint research project into the cost and effectiveness of mediation in the Magistrates Court.
