Find out what every employer and manager needs to know about the biggest changes to the Australian employment landscape for 60 years.

At the core of the change in the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Act 2022 is the obligation imposed on the employer or a person conducting a business or undertaking in ensuring their workplaces are free of sexual harassment.

This new positive duty requires proactive steps to prevent and/or eliminate conduct pertaining to:

  • Sexual harassment
  • Harassment on the grounds of sex
  • Sex discrimination
  • Subjecting a person to a hostile work environment on the ground of sex
  • Victimisation.

What does this mean for you?

  • Organisations should undertake a formal audit to assess the risk of sexual harassment in the workplace
  • Take steps to address and mitigate any risks
  • Review and update any relevant policies
  • Train staff on the new positive duty
  • Check the complaints handling process
  • Encourage staff to speak up.

Presenters

Shirli Kirschner

Shirli has a background in law and was a sessional Registrar at the Federal Circuits Court (Industrial list). She is also an awarded dispute resolution designer and the co-founder of Elker, a software company that creates digital safe spaces for reporting.

David Bryson

David Bryson has a background in change management with a degree from Oxford University.  He is a former Assistant Commissioner for Equal Opportunity in Victoria, a conciliator in workplace injury, a workplace mediator and head of triage for organisations, including a student colleges and disability housing.
