Getting back to the basics of mediation

Come along and hear from Jeniffer Drennan and Jonathon Spencer the fundamentals of the mediation process including the art of listening.

This is a highly interactive session where the presenters will explore some tools which can support all mediation practices. They aim to demonstrate that an understanding of some very basic skills such as listening can improve the approach of the mediator and the quality of outcomes. 

The culmination of a mediation often results in a negotiated position which is formalised as a ‘written agreement’. Such a document is often prepared hastily at the end of the day, so it is important that care is taken to provide clarity about exactly what is agreed and who is responsible for certain (in)actions, and any agreed time parameters are precisely detailed. This session will revisit a simple mnemonic acronym to improve future written agreements you may be asked to draft and provide the parties in a dispute with a clear pathway forward and an action plan on agreed communication protocols so things don’t go wrong.

This workshop is for lawyers and dispute resolution practitioners who interact within the specific dispute resolution context and provide CPD points for your professional fields. It will also help support regional dispute resolution practitioners.

About the presenters:

Jeniffer Drennan

Jeniffer Drennan is a Fellow of Resolution Institute and a Lawyer who is also a decision maker for a NSW Tribunal.  Jeniffer has first-hand practical experience in many forms of dispute resolution practice, gained over the previous 25 years as a dispute resolver. In concert with other professionals in Newcastle she assists to ensure that professional development opportunities are made available locally. Jeniffer obtained her law degree with honours, majoring in dispute resolution from the University of New England.

Jonathon Spencer

Jonathon Spencer is a taxation educational specialist with over thirty years experience in taxation administration with the Australian Taxation Office (ATO). His most recent role was as a Director in Review and Disputes, managing a team of specialist dispute resolvers. Previous roles involved the development and assurance of a range of dispute resolution policies and practices. Jonathon's extensive ATO career experience also includes a range of audit roles, technical skilling, community and international forums. In 2023 he moved into academia, as course co-ordinator/casual lecturer for the taxation law course at the University of Newcastle School of Law and Justice. Jonathon holds a number of degrees, including a Bachelor of Economics & Master of Educational Studies (University of Newcastle) and a Doctorate in Education (University of Sydney).
