NSW Government Data: Key Insights on Adjudication

By the Numbers: What does NSW Government Data tell us about the state of Adjudication?

NSW Fair Trading has been diligently publishing data on Adjudications since 2012 to “provide data on adjudication trends emerging in the construction industry.” This data is collected from ANAs, collated, and published as summary data in quarterly reports. In NSW, disclosing information about individual adjudications is an offence, so this summary data is all that is available.

This analysis of the available quarterly data since 2017 (when changes in reporting made the data incompatible with previous data) gives insights into the growth (or otherwise) of adjudication numbers and values, who wins, who loses, how much, and why. As adjudicators, we can fall into the trap of thinking that our experience is representative, but, as Dr Karl says: “the plural of anecdote is anecdotes, not data”.

For those who can’t wait, the answers are 6,610, $6.9 trillion, probably adjudicators, mostly claimants, and $0.9 trillion, and you’ll have to attend to find out why.

Dale Morrell

Dale Morrell is an engineer, adjudicator, and arbitrator.
Dale holds a BSc, BE (Electrical), and a MDesSc (Building Services) from Sydney University and an MBA (Executive) from the AGSM.
Since graduating in 1990, Dale has been involved in the building and construction industry as a consulting engineer with GHD and Wallis & Spratt and, since 1999, as an owner of Morrell Plumbing, a Sydney-based commercial plumbing contractor. He has consulted for Sofraco Engineering on engineering design and installation on RAN warships and was on the UNSW adjunct faculty, teaching data analysis and statistical modelling to MBA students.
