This workshop provides the skills and knowledge to assist those who work in any statutory or industry scheme conciliation process. The skills are not only relevant to conciliators but all those involved in the process including managers, intake staff and lawyers.

Who is this training for? 

  • Conciliators (or aspiring conciliators) and mediators who work within a statutory body or other government agency/association/ authority with a specific jurisdictional or legal focus
  • Mediators who have completed the five-day Resolution Institute mediation training
  • Those practicing the skillset such as managers, intake staff and lawyers 

What you will learn?

  • Understanding the theory and practice of conciliation, as distinct from mediation and other dispute resolution processes
  • Clarity as to what a good conciliation process looks like and the guiding principles for a conciliator
  • Understanding the role, responsibilities, and limitations of a conciliator
  • An overview of legislative foundations of conciliation (non-industry specific)
  • Conciliation models of practice and key conciliation skills and practice based on relevant roleplays
  • Expert knowledge and the application of administrative law and other general legal principles
  • Advocacy, authority, reporting requirements and ethical practice

Are there any prerequisites?

Either: 

  • Being an accredited mediator or
  • Experience in delivering mediation/conciliation/conferencing in a statutory or industry scheme

Assessment

There will be a short assessment which includes comprehensive and personalised feedback for each participant from our trainers. Participants will be asked to complete a written reflection on how they apply conciliation skills in their work. Our trainers will also provide each participant with feedback on their reflective writing, understanding of core concepts and demonstration of key skills during the live workshop. 


About our presenters

Exclusive to the online version, this training will be led by two of our Training Faculty together.

Shiv Martin

Shiv is a nationally accredited mediator, practicing lawyer, conciliator, decision maker and certified vocational trainer. She has engaged in complex dispute resolution, stakeholder engagement and team building in the government and legal sectors for 13 years. As a mediator, trainer and facilitator Shiv has a unique and diverse set of expertise in Law, Management, Vocational Education and Mediation.

Shiv works for various government organisations as an independent decision maker or conciliator and conducts private workplace mediations and facilitations. She is currently a part time Assistant Information Commissioner, Queensland. In this role she makes statutory decisions on the information and privacy rights of individuals, corporations and government entities. She manages teams and projects in public service dispute resolution.

Shiv is also an Independent Examiner with the Australian National Contact Point for OECD complaints. In this role Shiv conciliates, investigates, and makes decisions in relation to complaints made about the conduct of multinational companies. In this role, Shiv engages in complex, global conflict resolution that impacts on different cultural groups. As an experienced community mediator, Shiv has a keen interest and skill in conducting cross-cultural and intergenerational mediations. She is an active member of the South Queensland Dispute Resolution Centre where she continues to train, coach and assess aspiring mediators for NMAS Accreditation.

Recently, as a Conference Registrar for the Administrative Appeals Tribunal, Shiv conducted conciliations in a broad array of public sector disputes including tax, worker’s compensation and disability support (NDIS matters) and social services complaints.

Shiv’s greatest area of strength and passion is training and coaching in dispute resolution. She is a leading conciliation and public service trainer for the Resolution Institute, and facilitates reflective practice workshops for public service managers.

Justin Toohey

Justin is a highly experienced conciliator, mediator, lawyer and manager. Justin has developed his dispute management skills in senior government roles for over 20 years. His key qualifications include Masters of Law, Bachelors of Law and Environmental Science (Hons), Graduate Certificate in Management and Certificates IV in Training and Assessment and Community Mediation. Justin has been the Director of Alternative Dispute Resolution (ADR) at the Administrative Appeal Tribunal (AAT) for the last 10 years and leads a national team of high performing ADR professionals who resolve up to 95% of matters across 400 legislative frameworks.

Justin is dedicated to passing on his skills and knowledge in ADR and his trainer journey started in 2004 at the Registrar of Indigenous Corporations (ORIC). Justin established the first national mediation and dispute resolution service for Indigenous Corporations with a strong focus on dispute capacity building and co-design. In 2011, Justin developed and delivered the two day Fast Track Negotiation Skills program for the Queensland Information Commissioner with Professor Tania Sourdin and Shiv Martin.
